Mobile Application Privacy Policy

This policy (the "Policy") describes how Forefront Golf Inc. ("we", "us" or "our") collects, uses and discloses information which you provide in connection with your use of our mobile applications (each, an "Application'). We may update this Policy from time to time in order to address changes to the types of information we collect and the manner in which we collect, use and disclose that information, and to ensure our continued compliance with applicable privacy laws. In the event that we modify this Policy, we will immediately notify you of such modification(s) by placing a prominent notice, together with a link to the updated Policy, on the register screen of the Application. Under no circumstances will we amend this Policy without notice to you. By downloading, installing and using the Application, you acknowledge having read this Policy and expressly consent to our collection, use and disclosure of your information in accordance with the terms hereof, as may be amended. If you do not accept the terms of this Policy, please do not download, install or use the Application.

Collection of Information

When you download, install and/or use the Application, you may provide us with certain personally identifiable information, including your name, address, e-mail address, telephone number, user-generated user name and password, birth date, gender, contact lists, social connections and/or photographic images (collectively, the "Personal Information”). You may access and edit your Personal Information at any time through your Application account. If you contact us for technical or other assistance, we will keep a record of your correspondence and will treat it as Personal Information. We do not access or save information stored on your mobile device except with your express consent. In addition, the Application may automatically collect certain non-identifiable or anonymous information from your mobile device, including the type of mobile device being used, the unique identifier of the mobile device, Internet Protocol Address, Internet Service Provider, connection speed, diagnostic reports, usage patterns, and other aggregate or summary data, such as demographic statistics (collectively, the "Non-Personal Information). We may collect, use and share precise location data, including the real-time geographic location of your mobile device (the "Location Information”), but only with your express consent. You may revoke your consent to our collection and use of Location Information at any time by changing the location service preferences on your mobile device. We generally treat Location Information as Non-Personal Information.

Use of Information

We use Personal Information and Non-Personal Information for the following purposes: (a) to make the Application available to our users; (b) to determine eligibility for Application registration; (c) to provide users with support, services, information and assistance, upon request; (d) to improve the functionality of the Application; (e) to customize and improve the user experience; (f) to administer contests and promotions involving the Application and to contact and announce the winners of such contests and promotions; (g) to compile statistics and generate reports about the Application; (h) to investigate legitimate complaints regarding use of the Application; (i) to prevent and detect fraud, infringement and other misuse of the Application; and (j) to comply with requests for information from law enforcement agencies and regulatory authorities, as described in greater detail below.

Disclosure of Information

We are not in the business of selling information to third parties. We will only disclose your Personal Information to third parties in the following circumstances: (a) where you have specifically consented to the disclosure of your Personal Information for a designated purpose; (b) where we have engaged a third party agent to provide services in relation to the Application, for example, payment processing, data storage, software maintenance, web analytics, development, or functionality integration, and such third party has agreed to maintain the confidentiality of your Personal Information and to use the Personal Information solely for the purpose of providing the designated services; (c) where we are required to disclose your Personal Information by law, including by an order of any court, institution or body with jurisdiction or authority to compel the production of such information; and (d) where we sell, transfer or otherwise dispose of some or all of our assets, including by way of a corporate reorganization, merger, amalgamation or acquisition.

Revocation of Consent

You may revoke your consent to the collection, use and disclosure of your Personal Information at any time by deleting your Application account. In the event that you delete your Application account, we will dispose of your Personal Information in the manner described below.

Retention of Personal Information

We retain Personal Information for the period necessary to fulfill the purposes outlined in this Policy, unless a longer retention period is required or permitted by applicable law. We take reasonable steps to delete, erase or destroy Personal Information which we no longer require. In the event that you submit user-generated content in connection with one of our contests, we may retain and allow other users to access such content after you have deleted your Application account, unless you specifically request that we delete the content, in which case we will delete it within 60 days following receipt of your request.

Security

The security of your Personal Information is of utmost importance to us. We use appropriate measures to protect Personal Information from loss, theft, and unauthorized access, use, modification and disclosure. These measures include: (a) performing internal and external reviews of our current security practices; (b) implementing industry-standard security measures; (c) aggregating data, where appropriate; and (d) entering into confidentiality agreements with key employees, agents and service providers who have access to Personal Information. Please be aware, however, that no information system is 100% secure and we cannot guarantee that your Personal Information will be protected against all potential security breaches. In order to assist us in the protection of your Personal Information, please keep your user name and password strictly confidential and notify us immediately of any unauthorized use of, or interference with, your Application account.

Unlawful Activity

We reserve the right to cooperate with local, national and international law enforcement agencies and other regulatory authorities in the investigation of improper or unlawful activities involving the Application. If such an investigation requires the disclosure of Personal Information in our records, we will cooperate. We also reserve the right to report unlawful activity occurring through the Application, which may require the disclosure of Personal Information of those persons engaged in such unlawful activity.

Third Party Content

The Application may contain links to third party websites, applications, advertisements, products and/or features. This Policy applies only to information which we collect through the Application. We are not responsible for the privacy practices of third parties and urge you to review all third party privacy policies before providing Personal Information to the relevant third party.

International Users

Our collection, use and disclosure of Personal Information is subject to the Personal Information Protection and Electronic Documents Act (Canada) and equivalent provincial legislation (the "Canadian Privacy Laws”). You acknowledge that this Policy has been prepared in accordance with Canadian Privacy Laws and that such laws may be less stringent than the laws of the country in which you reside.

Hosting of Information

We may store your Personal Information on servers located in other countries, including the United States. Your Personal Information may be subject to the laws of the countries in which it is stored, and those countries may observe a different data protection regime than the country in which you reside. In certain circumstances, courts, law enforcement agencies and regulatory authorities in those other countries may be entitled to access your Personal Information. By providing us with Personal Information and accepting the terms of this Policy, you consent to the transfer of your Personal Information to other countries, including the United States.

Children Under 13

We do not knowingly or intentionally collect Personal Information from children under the age of 13 and do not knowingly or intentionally permit such persons to download, install and/or use the Application. If you become aware that a child under the age of 13 is using the Application and has provided us with Personal Information, please notify us immediately. If we determine that we have collected Personal Information from a child under the age of 13, we will delete all such information as soon as reasonably practicable.
